Lumichron (referred to as “Lumichron,” “Company,” “us” or “we”) is committed to protecting the privacy of the users of its website (the “Site”). This policy discloses the Company’s privacy practices as they pertain to the Site and applies to information we collect when you interact with us online (e.g., through this Site or other online products and services) or offline (e.g., when you speak with customer support) or otherwise interact with us as described below. Our online and offline services and interactions with you are collectively referred to as “Services” in this policy. This purpose of this policy is to inform you a) of the kinds of information the Company collects from users of the Site and how such information is collected; b) how this information is used by the Company; c) the security procedures that the Company uses to protect user information; and d) whether the Company discloses any user information to third parties.

Information we collect directly from you.  We do not collect any personal information about you unless you voluntarily provide it directly to us.  This information (“Personally Identifiable Information” or “PII”) may be collected when you: a) contact us directly via phone or email; b) submit a form on our website; c) provide product reviews; d) communicate with us via third-party social media sites; e) and/or submit your credit card or other payment information when ordering and/or purchasing goods and services; and/or f) otherwise communicate with us.  To wit, we will use your information for communicating with you in relation to services and/or products you have requested from us, and to deliver and/or provide the services you have requested.  We may also use your personally identifiable information to inform or notify you of other products or services available from Lumichron and its partners. The types of PII we may collect include your name, email address, zip or postal code, billing address, shipping address, phone number, payment card information, and any other identifying information you choose to provide.
  2. Information we collect automatically. We may automatically collect certain information about you when you access or use our Site and/or Goods and Services. This information may include: a) information about your use of the Site, such as the type of browser you use, access times, pages viewed, your IP address and the referring link through which you accessed the Site; b) information about the device you use to access our online Services, including the hardware model and operating system and version; c) information about a purchase or return, such as product details and the date and location of purchase/return; and d) information about you when you interact with this Site, including information about your browsing behavior. This information is collected in a variety of different ways including by Lumichron and by Google Analytics, is compiled and analyzed on both a personal and an aggregated basis, and in a manner that may allow the Company or any affiliated entities to improve our services.

The information that the Company collects is used for internal purposes in connection with the facilitation, recording and processing of any requests, orders, communications, or interactions you may have with the Site. Such information may be used to a) provide, maintain and improve our Services, including to facilitate and improve your online experiences; b) deliver the products and services you request, process transactions and send you related information, including confirmations and receipts; c) provide you with customer service; d) provide you with information and updates pertaining to your online profile, the Site’s Terms and Conditions, this Privacy Policy and any other Company news or updates; e) detect, investigate and prevent fraudulent transactions and other illegal activities and protect our and others’ rights and properties; f) resolve disputes, diagnose problems with servers or software, and troubleshoot problems; g) measure the number of visits, average time spent on the Site, pages viewed and other such statistics pertaining to traffic on the Site; and h) personalize your online experience and provide advertisements, content, or features that match your profile and interests.

Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

This Site may contain links to sites other than our own. Those sites may have their own privacy policy, or no privacy policy at all. Neither we nor any of our Service Providers have any responsibility for those sites, and we provide these links solely for the convenience of our visitors. Neither Lumichron nor any of our Service Providers control the content that appears on these sites or take any responsibility for their content, nor should it be implied that Lumichron endorses or otherwise recommends such sites or their products or services offered. Once you leave this Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or this Site’s Terms and Conditions.

SECTION 5 – Third Party Providers

  1. Site Hosting. We use a third party server to host this Site called Bluehost, the privacy policy of which is available here https://www.endurance.com/privacy/privacy.

SECTION 6 – Testimonials

We may display personal testimonials of satisfied customers on our Site, in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at info@Lumichron.com.

SECTION 7 – Advertising and Other Tracking Technologies

We may engage third parties to serve advertisements on our behalf across the Internet and to provide analytics services. These entities may use cookies, web beacons and other technologies to collect information about your use of this Site, such as your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on this Site and better understand your online activity.

SECTION 8 – Security and Data Retention

To the extent we store any of your PII, you can be assured that your PII is secure, consistent with current industry standards. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of PII. For example:

  • We only keep collected information and use it only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention
  • We limit access to PII only to specific employees, contractors and agents who have a reasonable need to come into contact with your information.
  • We employ a number of physical, electronic, and procedural safeguards to protect PII. Our secure servers and our data centers are protected by industry-standard encryption, and our servers reside behind firewalls and employ high-level password protection.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect PII, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed.

We do not collect, access, store or process any credit card information. Please read the privacy policy on Bluehost’s, our payment processor’s, website regarding the use, storage and protection of your credit card information before submitting any credit card information. However, to the extent you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. We follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Our retention periods for personal data are based on business needs and legal requirements. We retain personal data for as long as is necessary for the processing purpose(s) for which the data was collected and any other permissible, related purpose. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired.

SECTION 9 – Cookies

This Site uses cookies and similar technologies. A cookie is a small data text file which is stored on your computer that uniquely identifies your browser. PROVISIONS THAT APPLY WHEN INDIVIDUALS ARE BASED IN THE EUROPEAN UNION AND/OR THE UK.

Lumichron complies with all applicable requirements of the Data Protection Legislation and the with the General Data Protection Regulation (GDPR) that went into effect on May 25, 2018. It was passed by European lawmakers to create a harmonized data privacy law across all the EU member states. Its purpose is to:

  • support privacy as a fundamental human right,
  • require companies that handle personal data to be accountable for managing that data appropriately, and
  • give individuals rights over how their personal data is processed or otherwise used.

These conditions are supplemental to the terms set out above and apply where individuals are located in the EU and /or UK.  Data Protection Legislation means the General Data Protection Regulation ((EU) 2016/679), the UK Data Protection Legislation and any other directly applicable European Union regulation relating to privacy.  UK Data Protection Legislation means any data protection legislation from time to time in force in the UK including the Data Protection Act 1998 or 2018 or any successor legislation.   • We will only transfer your Personal Data to countries that have been deemed to provide an adequate level of protection for Personal Data by the European Commission.
